In the case of a traffic accident that was not your fault, it is advisable to seek legal support at an early stage. A lawyer handles communication with the opposing insurer, asserts all your claims, and ensures that you do not suffer any financial disadvantages.
In the case of a traffic accident that was not your fault, the necessary lawyer's fees are generally part of the recoverable damage and must be borne by the opposing liability insurer (Haftpflichtversicherung). In the case of contributory liability, the assumption of costs is based on the respective liability quota. In the case of an accident you caused yourself, your own legal expenses insurance (Rechtsschutzversicherung) may cover the costs, depending on the insurance contract.
After a traffic accident, you must generally be put in the position you would have been in if the accident had not occurred. Which claims you are entitled to depends on the circumstances of the individual case. In particular, the following may be considered: repair costs, replacement value (Wiederbeschaffungsaufwand), diminished value (Wertminderung), loss of use (Nutzungsausfall), rental car costs, expert assessment costs, compensation for pain and suffering (Schmerzensgeld), or loss of earnings.
If there is a material defect (Sachmangel), depending on the individual case there may be claims for subsequent performance (Nacherfüllung), price reduction (Minderung), withdrawal from the purchase contract (Rücktritt), or damages. I will gladly examine whether the statutory requirements are met and which rights you can assert as part of an initial consultation (Erstberatung).
To ensure that your warranty rights (Gewährleistungsrechte) are not jeopardized, the defect should be documented and the seller informed as soon as possible. It is often necessary to first set the seller a reasonable deadline for subsequent performance (Nacherfüllung).
An objection (Einspruch) can be filed against a fine notice (Bußgeldbescheid) within two weeks of service. Whether an objection is advisable depends on the circumstances of the individual case.
